Have You Been Hit by an Uninsured Motorist in TX? You May Have Ways to Recover Damages

The state of Texas requires all motorists to have some basic level of vehicle liability insurance. But this required amount can often not be enough to cover the expenses of an actual car crash. A driver in this situation is called an under-insured motorist. If a driver simply chooses to have no insurance despite the law, we call them uninsured motorists. More about car accident lawyer Houston here.
By law, your insurance company is required to offer additional coverage for accidents with uninsured and under-insured motorists (UM and UIM, respectively). This coverage comes in two types: bodily injury and property damage.

Bodily injury insurance covers your hospital or medical bills, any lost wages you may incur, and compensation for any pain and suffering or disfigurement as a result of the accident. There is no deductible associated with this coverage.

Property damage insurance covers damage to your vehicle or any of your property within your vehicle. It also covers the price of a rental car while your vehicle is being repaired. A deductible is associated with this coverage.

Even if you have no UM/UIM coverage, there may be ways to recover some damages if you are in an accident with an uninsured or under-insured motorist. If you are in an accident with a UM/UIM, contact the uninsured auto accident attorneys at our Texas Law Office and let us make sure your injuries are fully compensated. But understanding these kinds of “budget” insurance providers helps you also appreciate just how difficult this road can be. It should also illustrate why you, if you take on these insurance companies by yourself, or an inexperienced attorney who quotes you a great “rate”, will cause you more problems than they solve; and make you a victim in this auto accident a second time.

An experienced local attorney with our Law Firm will analyze your case, and explain your options so that you will fully understand them. We want to make certain that you recover as much as reasonably possible for your injuries and make this sometimes complicated legal process as easy as for you to understand and navigate to a successful end. Then you can resume your life: free from financial harm, and with this experience in your rearview mirror.

Laredo Car Accidents : Personal Injury Law

Personal injury by definition is any accident that either leaves physical or psychological damage to the person. You will find that personal injury encompasses many different areas not only car accidents but accidents at work, home, holidays, certain diseases, and other issues. When someone has had a medical or dental accident, mesothelioma, chest diseases as a result of emphysema, other diseases and even repetitive strain on their body, they can file a personal injury law claim.

The accident has to be a result of someone else. In a personal injury law case the injured party can be compensated for the expenses the injury has caused as well as for long term damage. For someone who has caused a car accident while intoxicated the injured party or family is entitled to some type of monetary compensation. The same would be said for any personal injury. The person at fault must make some type of restitution in the court of law. When discussing personal injury both parties will need a personal injury lawyer.

The person at fault is either found to have been negligent in their conduct or the charges will be dismissed. The injured party must supply evidence for the judge or jury to support the claims. If the person causing the personal injury was indeed negligent behind a car, machine, or in the other cases, they will have to make restitution with monetary means, and depending on the type of personal injury they may be brought up on other charges. An example – in a car accident the person not at fault is actually killed. The case would then turn to vehicular manslaughter or homicide. In this case the family can take the case to court, and anyone else in the car not only for vehicular manslaughter, but also in a personal injury case.

In order to fully understand personal injury in a court of law you will need to hire a lawyer. You will also have specific requirements for filling a claim. In some cases the states require that the case begins within two years of the personal injury. If you wait longer to obtain the evidence you need or get a court appointment the case may not be prosecuted. You will also find there are chances for plea bargains in personal injury cases. The company or person may settle for a sum agreed on and pay it without the court, just the lawyers. In this case a person may find there is more to save in court costs than there was in proceeding to court. The court in a personal injury case usually decides the monetary compensation.

To find a personal injury lawyer you will want to start off by asking your friends or family for references. You may even ask your other lawyer for references. In the business community you are often better off seeking references or referrals to find the best professional. You can use the internet, but again you still want to do a little research into their company, such as cases won and lost, fees, and other information.

Personal Injury Law – Car Accidents – Automobile Insurance

Everyone who drives a motor vehicle on a public roadway in Texas must purchase – at a minimum – three types of automobile insurance.

All Texas drivers must have:

1.Liability Insurance: This insurance covers damage to other people’s property, including vehicles, if you are in an accident. In Texas, Liability insurance does not cover medical expenses.

2.Personal Injury Protection (PIP) Insurance: This is the insurance that pays for medical claims by you or by anyone else involved in an accident that involves your vehicle. In Texas this is sometimes referred to as No-Fault insurance since this portion of your insurance pays for medical expenses regardless of whose fault the accident is eventually deemed to be. 3.Uninsured Motorist (UM) Insurance: This insurance pays for both medical claims as well as property damage if you are involved in an accident with someone who does not have any insurance or who does not have sufficient insurance to cover the claims resulting from an accident.

The basic minimum coverage in Texas is what is known as 15/30/5. What this means is that you are required to have Personal Injury Protection Insurance (PIP) that covers up to $15,000 of medical protection per individual with a cap of $50,000 of medical coverage per accident. You are also required to carry $5,000 of Liability Insurance to cover any property (including vehicles) that you might damage in an accident.

Under Texas state law you are not required to have any other coverage in order to drive a vehicle. However, if your car is being financed then your lender may very well require that you also purchase comprehensive coverage as well as collision coverage and that you buy considerably more than the state-required minimum for Liability, PIP and Uninsured Motorist.

Even if you own your car outright and are not required to purchase anything more than the bare state minimum for insurance you may very well choose to carry higher coverage. This is especially true for anyone who owns a home, has a savings account, or for anyone who has any other assets that they wish to protect.

Just one accident-spawned lawsuit could see your home taken from you, your bank account wiped out, and any and all other assets that you own turned over to the prevailing party. In other words, if you don’t have sufficient automobile insurance coverage you could lose everything in an accident.

Once you (or your lender) have decided on the amount of your full coverage insurance then it is time for you to go online and find at least 3 of the dozens of websites that will let you quickly and easily find out how much your policy will cost from different insurance companies. You will find that there can be a considerable difference in price from one company to another.

Don’t get lazy and just compare prices on one website. No website compares prices from all the different insurance companies, so if you want to insure that you are seeing the widest range of prices possible you will need to make your comparisons on at least 3 different websites.

But once you’ve done that then all you need to do is to choose the lowest price and you’re done. You now know what to look for in a full coverage car insurance quote in Texas and you know how to find the best price for your coverage.
